Foreigners have expanded opportunities to purchase or invest in Mexican real estate, because at these days, the purchase of real property has the same legal basis as in the United States. The Mexican Constitution of 1917, however, prohibited foreign ownership of residential real property within approximately 31 miles of any coastline and 62 miles of its natural borders, but there is a mechanism that allows foreigners to own property in the “restricted zone”. It is the bank trust or “fideicomiso”. In the Bank Trust the buyer of the property is designated as the “fideicomisario” or the beneficiary of the trust. While legal title is held by the bank, the trustee must administer the property in accordance with the instructions of the buyer. The property is not an asset to the bank and the trustee is obligated to follow every lawful instruction given by the beneficiary to perform legal actions (rent it, sell it, make improvements). As a trustee, the bank acts on behalf of the beneficiary in transactions involving the property, including the decision to transfer, assign or otherwise dispose of his or her interest in the property. The trust is essentially a contractual arrangement which, in most respects, is identical to the type of trust used in North America. Trusts are established for an initial 50 year periods and can be renewed.
